Terms & Conditions
Welcome to Gulf View Properties, LLC.
This Rental Agreement and Terms & Conditions apply to every reservation made with Gulf View Properties. By booking a reservation, completing payment, electronically accepting this agreement, or occupying one of our vacation homes, you agree to be bound by these terms.
Please review this agreement carefully before your arrival.

Section 1 – Reservation, Rental Agreement & Security Deposit
Reservation Confirmation
A reservation is confirmed only after:
-
All required payments have been received.
-
This Rental Agreement has been accepted.
-
All booking requirements have been completed.
Until these requirements are met, your requested reservation dates are not guaranteed.
The person making the reservation must be at least 21 years old and is responsible for everyone staying at the property.
Security Deposit
A refundable Security Deposit may be required at the time of booking.
The Security Deposit may be used to cover:

Damage beyond normal wear and tear
-
Missing or stolen items
-
Excessive cleaning
-
Unauthorized pets
-
Smoking or vaping indoors
-
Unauthorized guests or parties
-
Furniture not returned to its original location
-
Excessive trash removal
-
Unauthorized streaming or pay-per-view purchases
-
Other costs resulting from violations of this Agreement
If damages exceed the Security Deposit, the Guest is responsible for paying the remaining balance.
Fraudulent Reservations
Reservations made using false information, fraudulent payment methods, or stolen credit cards may be canceled immediately without refund.
Payment Schedule

Reservations made 30 days or less before arrival require full payment at booking.

Reservations made more than 30 days before arrival must be paid in full at least 30 days before check-in.
Failure to make payment on time may result in cancellation of the reservation.
Reservation Acceptance
Submitting a reservation request or payment does not guarantee acceptance. Gulf View Properties reserves the right to refuse or cancel any reservation that does not comply with this Agreement.
Guest Identification
Guests may be asked to provide:

The credit card used to make the reservation
The name on the reservation must match the identification provided.
Acceptance of Agreement
By completing a reservation, electronically accepting this Agreement, signing this Agreement, or checking into the Property, the Guest agrees to all Terms & Conditions and accepts responsibility for everyone included in the reservation.
Section 2 – Cancellations, Changes & Manager Rights
Guest Cancellations
Cancellation requests must be submitted in writing by email or through the booking platform used to make the reservation.
Refund Policy

More than 30 days before arrival: Rental payments will be refunded, less any non-refundable fees disclosed at booking.
-
30 days or less before arrival: Amounts paid may be forfeited unless Gulf View Properties is able to re-rent the property or agrees in writing to provide a full or partial refund.
Approved refunds will be issued using the original payment method whenever possible.
Early Departures & Changes
Refunds or credits are not provided for:

Early departures
-
Late arrivals
-
Shortened stays
-
Changes in occupancy
-
Personal emergencies
-
Illness
-
Road closures
-
Weather that does not require a mandatory evacuation
-
Utility interruptions or equipment failures beyond our reasonable control
Reservation Changes
Requests to change reservation dates, occupancy, or the reserved property are subject to availability and approval.
Approved changes may result in:

Updated rental rates
-
Seasonal pricing adjustments
-
Minimum-stay requirements
-
Administrative fees
Cancellations by Gulf View Properties
If a property becomes unavailable because of maintenance, damage, severe weather, mandatory evacuation, utility failures, or other circumstances beyond our control, Gulf View Properties may cancel the reservation before check-in.
If this happens, all rental payments received for the reservation will be refunded.
Right to Refuse or Terminate Occupancy
Gulf View Properties may refuse or terminate a reservation without refund if a Guest:

Violates this Agreement
-
Provides false information
-
Exceeds maximum occupancy
-
Hosts unauthorized parties or events
-
Engages in illegal activity
-
Creates excessive noise or disturbances
-
Endangers the property or others
-
Fails to follow reasonable instructions from management
Guests remain responsible for any unpaid charges or damages.
Severe Weather
Our properties are located on the Mississippi Gulf Coast, where tropical storms, hurricanes, and flooding may occur.
Refunds are not provided for unfavorable weather unless a mandatory evacuation is required by law or otherwise provided at Gulf View Properties' discretion.
Travel Insurance
We strongly recommend purchasing travel insurance to protect against unexpected events such as:

Trip cancellations

Travel delays
-
Medical emergencies
-
Severe weather
-
Mandatory evacuations
Travel insurance may reimburse expenses that are not covered under this Rental Agreement.
Section 3 – Check-In, Check-Out & Occupancy
Check-In
-
Standard check-in begins at 3:00 PM on your scheduled arrival date.
-
Check-in instructions, including keypad codes and property access information, will be sent before your arrival after all required payments and documents have been received.
-
Early check-in is subject to availability and may require an additional fee.
Check-Out
Check-out time is 11:00 AM unless approved in advance.
Before leaving, please:
-
Remove all food from the refrigerator.
-
Place used dishes in the dishwasher and start the wash cycle.
-
Dispose of trash in the designated outdoor containers.
-
Return furniture to its original location.
-
Return remote controls where they belong.
-
Set the thermostat to 83°F in summer or 55°F in winter, unless instructed otherwise.
-
Turn off lights and small appliances.
-
Close and lock all doors and windows.
-
Leave the property in a reasonably clean condition.
Failure to follow these procedures may result in additional cleaning or damage charges.
Occupancy
-
The number of guests may not exceed the maximum occupancy listed for the property.
-
Only registered guests may stay overnight.
-
Parties, receptions, weddings, and unauthorized events are not permitted without written approval.
Violations may result in termination of your reservation without refund and additional charges.
Minimum Age
The primary Guest must:
-
Be 21 years of age or older.
-
Remain at the property for the entire reservation.
-
Accept responsibility for everyone in the rental party.
Right of Entry
Gulf View Properties may enter the property when reasonably necessary to:
-
Perform maintenance or repairs.
-
Inspect for damage or Agreement violations.
-
Respond to emergencies.
-
Address maintenance requests.
-
Protect the safety of guests or the property.
Whenever practical, reasonable notice will be provided before entry. Immediate entry may occur during emergencies or when necessary to protect people or property.
Section 4 – Property Rules, Conduct & Guest Responsibilities
Quiet Enjoyment
To ensure everyone has an enjoyable stay, Guests are expected to be respectful of neighbors and surrounding properties.
Quiet Hours: 10:00 PM – 8:00 AM, unless otherwise posted.
Please avoid excessive noise or disruptive behavior during your stay.
Prohibited Activities
The following activities are not permitted unless approved in writing by Gulf View Properties:

Parties, weddings, receptions, or events
-
Illegal activities of any kind
-
Illegal drug use or distribution
-
Excessive or disorderly alcohol-related behavior
-
Excessive noise or disturbances
-
Fireworks or explosives
-
Candles or open flames inside the property
-
Tampering with smoke detectors or safety equipment
-
Subletting or transferring your reservation
-
Commercial photography or filming without approval
-
Altering or removing fixtures, appliances, locks, or utilities
Violations may result in immediate termination of your reservation without refund and additional charges.
Smoking & Vaping
Smoking and vaping of any kind, including tobacco, nicotine, cannabis, or similar products, are not permitted inside the property.
Evidence of indoor smoking or vaping may result in additional cleaning, deodorizing, repair costs, and other related charges.
Pets
Pets are welcome only at designated pet-friendly properties and must be approved before arrival.
Guests are responsible for:

Supervising pets at all times
-
Cleaning up after pets
-
Any damage or additional cleaning caused by pets
Unauthorized pets may result in additional fees or termination of the reservation.
Swimming Pools
If your property includes a swimming pool:

Use the pool at your own risk.
-
Children must always be supervised by an adult.
-
No glass containers are permitted in the pool area.
-
Follow all posted pool rules.
Sauna
If your property includes a sauna:
-
Use it at your own risk.
-
Follow all posted safety instructions.
-
Stay hydrated.
-
Exit immediately if you feel dizzy, overheated, or unwell.
Children must always be supervised.
Grills & Fire Safety
Guests are responsible for using grills safely.
Please:

Follow all manufacturer instructions.
-
Keep grills away from structures and combustible materials.
-
Never leave a grill unattended while in use.
Guests are responsible for any damage caused by improper grill use.
Parking
Please park only in designated parking areas.
Boats, trailers, RVs, or additional vehicles require prior approval.
Unauthorized vehicles may be towed at the owner's expense where permitted by law.
Community Rules
Guests must comply with:

All federal, state, and local laws

HOA or condominium rules
-
Community regulations
-
Posted property rules
Guests are responsible for any fines or penalties resulting from violations.
Exterior Security Cameras
Some properties may have exterior security cameras or doorbell cameras for the safety of guests and the property.
No recording devices are installed inside living areas, bedrooms, or bathrooms.
Tampering with security equipment is prohibited.
Smart Home Technology
Some homes include:

Smart thermostats
-
Electronic locks
-
Water leak sensors
-
Noise-monitoring devices
-
Exterior security systems
Noise monitors measure sound levels only and do not record conversations.
Guests may not disable or tamper with these devices.
Weapons
Guests must comply with all applicable firearm and weapon laws.
Any firearm brought onto the property must be lawfully possessed and stored safely.
The discharge of firearms or other weapons on the property is prohibited except where permitted by applicable law.
Section 5 – Property Care, Housekeeping & Departure Responsibilities
Linens, Towels & Starter Supplies
Your rental includes bed linens, bath towels, and a starter supply of household essentials such as:

Toilet paper

Paper towels
-
Trash bags
-
Dish soap
-
Dishwasher detergent
-
Laundry detergent
-
Bath soap
These supplies are intended to help you get started. Guests are responsible for purchasing any additional supplies needed during their stay.
Beach towels are provided only when specifically listed in the property's amenities.
Housekeeping During Your Stay
Daily housekeeping is not included unless specifically arranged before your arrival.
Additional housekeeping services may be available for an extra fee and are subject to availability.
Departure Cleaning
Your cleaning fee covers normal cleaning after a typical stay.
Additional cleaning charges may apply for:

Excessive trash

Food left in the refrigerator
-
Dirty dishes left throughout the property
-
Furniture moved and not returned
-
Excessive stains
-
Smoke or pet odors
-
Excessive pet hair
-
Failure to follow check-out instructions
Damage Reporting
Please report any accidental damage, maintenance issue, water leak, equipment malfunction, or unsafe condition as soon as possible.
Prompt reporting helps us resolve issues quickly and minimize additional damage.
Damage & Missing Property
Guests are financially responsible for damage beyond normal wear and tear.
Charges may include:

Repairs
-
Replacement of damaged or missing items
-
Additional cleaning
-
Labor and service fees
-
Administrative costs
-
Lost rental income when applicable
Lost & Found
Gulf View Properties is not responsible for personal belongings left behind.
If requested, we will make reasonable efforts to locate and return recovered items.
Guests are responsible for shipping costs, packaging, insurance, and any applicable handling fees.
Unclaimed items may be donated or discarded after a reasonable period.
Property Condition Upon Arrival
Please inspect the property shortly after arrival.
If you notice:

Damage

Missing items
-
Cleaning concerns
-
Maintenance issues
please notify Gulf View Properties within 24 hours of check-in so we can address the issue promptly.
Section 6 – Maintenance, Utilities & Emergencies
Maintenance & Repairs
We work hard to keep every vacation home clean, safe, and well maintained.
If you discover a maintenance issue, equipment malfunction, water leak, or unsafe condition during your stay, please notify Gulf View Properties as soon as possible.
Please do not attempt to repair, modify, disconnect, or reset appliances, locks, utilities, HVAC systems, or other equipment unless authorized by Gulf View Properties.
Utilities & Internet
Your rental may include:

Electricity

Water
-
Sewer service
-
Heating and air conditioning
-
Wi-Fi
-
Television service
Temporary interruptions may occasionally occur because of severe weather, utility providers, maintenance, or circumstances beyond our control.
Wireless internet is provided as a convenience. We cannot guarantee internet speed, uninterrupted service, compatibility with every device, or suitability for remote work, gaming, or streaming.
Appliances & Amenities
Every reasonable effort is made to keep appliances and amenities in working order.
These may include:

Air conditioning
-
Heating
-
Televisions
-
Wi-Fi
-
Swimming pools
-
Saunas
-
Kitchen appliances
Temporary equipment failures or maintenance issues generally do not qualify for refunds unless required by law.
Emergencies
For any emergency involving:

Fire
-
Medical assistance
-
Criminal activity
-
Immediate danger to people or property
Call 911 immediately.
After contacting emergency services, notify Gulf View Properties as soon as it is safe to do so.
Properties generally do not include landline telephones. Guests should keep a working mobile phone available throughout their stay.
Guest Responsibilities During Emergencies
Guests are expected to:

Follow evacuation orders.
-
Follow emergency instructions from first responders.
-
Comply with directions from local authorities and Gulf View Properties.
Failure to follow emergency instructions may increase the Guest's responsibility for resulting damages where permitted by law.
Swimming Pools
Pools are professionally maintained, but weather, maintenance, or equipment issues may occasionally affect availability.
Please report any unsafe condition or equipment malfunction immediately.
Temporary pool closures generally do not qualify for refunds.
Saunas
If your property includes a sauna, temporary maintenance or service interruptions may occasionally occur.
Please report any unusual odors, electrical concerns, overheating, or equipment problems immediately.
Do not attempt repairs.
Humidity, Moisture & Mold Prevention
Because the Mississippi Gulf Coast has a warm, humid climate:

Keep doors and windows closed while the air conditioner is operating.
-
Use bathroom exhaust fans when appropriate.
-
Report water leaks, standing water, unusual odors, or visible mold immediately.
Prompt reporting helps prevent damage and keeps the property comfortable for everyone.
Pest Control & Wildlife
Our homes receive regular pest-control service.
However, because of our coastal environment, you may occasionally encounter:

Ants
-
Mosquitoes
-
Palmetto bugs
-
Geckos
-
Spiders
-
Birds
-
Other local wildlife
Please report infestations or unsafe wildlife encounters promptly.
Do not feed wildlife around the property.
Section 7 – Liability, Assumption of Risk & Legal Terms
Assumption of Risk
Guests use the property and its amenities at their own risk.
This includes, but is not limited to:

Swimming pools
-
Saunas
-
Decks and balconies
-
Stairs and walkways
-
Docks and waterfront areas
-
Beaches
-
Grills
-
Parking areas
Guests accept responsibility for their own safety and for supervising children, pets, and all members of their party.
Limitation of Liability
To the fullest extent permitted by law, Gulf View Properties, the property owner, and their representatives are not responsible for injuries, illnesses, accidents, theft, loss of personal property, or damages arising from the use of the property, except where liability cannot legally be limited.
Guests are responsible for protecting their own belongings throughout their stay.
Exclusive Remedies
Unless otherwise required by law, the remedies described in this Agreement are the Guest's exclusive remedies.
Gulf View Properties is not responsible for indirect or consequential damages such as:

Lost vacation time

Lost wages
-
Travel expenses
-
Substitute lodging
-
Business interruptions
-
Emotional distress
Personal Property
Guests are responsible for securing their personal belongings.
Gulf View Properties is not responsible for lost, stolen, or damaged personal property left at or around the property.
Force Majeure
Gulf View Properties is not responsible for delays, cancellations, interruptions, or changes caused by events beyond our reasonable control, including:

Hurricanes

Tropical storms
-
Flooding
-
Fires
-
Utility failures
-
Pandemics
-
Government actions
-
Evacuation orders
-
Labor disputes

Transportation disruptions

Other unforeseen emergencies
Governing Law
This Agreement is governed by the laws of the State of Mississippi.
Unless otherwise required by law, legal proceedings relating to this Agreement shall be brought in Hancock County, Mississippi.
Severability
If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
This Agreement, together with any property-specific rules, booking confirmations, and written amendments, represents the complete agreement between Gulf View Properties and the Guest.
Electronic Acceptance
By booking a reservation, electronically accepting this Agreement, submitting payment, or occupying the property, the Guest agrees to all Terms & Conditions contained in this Agreement.
Section 8 – Privacy, Payment Security & Guest Acknowledgment
Privacy
Gulf View Properties respects your privacy and is committed to protecting the personal information you provide during the reservation process.
We may collect information such as:

Payment Security
Online payments are processed using secure, industry-standard payment processing and encryption technology.
While we take reasonable steps to protect your information, no online system can guarantee complete security. By submitting payment electronically, you acknowledge this inherent risk.
Chargebacks & Payment Disputes
If you believe a billing error has occurred, please contact Gulf View Properties before filing a chargeback with your credit card company.
If a chargeback is filed for a valid charge, Gulf View Properties may provide supporting documentation—including the Rental Agreement, booking records, communications, invoices, and other relevant records—to the payment processor or financial institution.
Nothing in this section limits your right to dispute an unauthorized or invalid charge where protected by law.
Guest Certification
By making a reservation, electronically accepting this Agreement, signing this Agreement, submitting payment, or occupying the property, you certify that:

You agree to comply with all Terms & Conditions.

You are at least 21 years of age.
-
You accept responsibility for all occupants, visitors, and approved pets included in your reservation.
Guest Acknowledgment
Electronic acceptance of this Agreement is sufficient when permitted by the reservation process.
