Terms, Conditions and Agreement
Deposit Requirements
A Security/Damage Deposit is required at booking in order to confirm your reservation. If guest fails to rent property for agreed term, this deposit will be nonrefundable. If guest rents the said property for the agreed term, this deposit will be used as the damage deposit. This deposit will be refunded within 30 days after your departure provided no additional expenses are incurred and property is left in good condition. If expenses are incurred to repair damage, replace missing items, pay for extra cleaning, return furniture back to its original location, if number of guest or pets exceed amount specified, smoking on the property, or any other violations of this rental policy as a result of your stay, we reserve the right to apply the damage deposit to offset expenses and administrative fees. Should guest incur charges on internet, cable, or streaming device, etc., or should the damages exceed the damage deposit amount, guest gives Gulf View Properties, LLC. permission to add the charges to the guest's credit card. A copy of the bill and the charge slip will be sent to the guest if this situation occurs.
*Unauthorized pets found on the premises will result in the forfeit of the security deposit.
If it is found that the number of overnight guest or visiting guest exceed the max amount of people specified, or if any parties are held on the premise, your security deposit will be forfeited and fees will be incurred.
Reservations
Reservations made within 30 days of arrival date will require full payment of reservation at the time of booking in order to confirm your reservation.
All reservations must be paid in full 30 days prior to arrival date or reservations will be canceled and the security deposit will be forfeited.
Falsified Reservations:
Any reservation obtained under false pretense will be subject to forfeiture of Security Deposit, and/or balance of rental payment. Guest will not be permitted to check-in or will be evicted per Mississippi Code of 1972, section 75-73-13. http://www.mscode.com/free/statutes/75/073/0013.htm
Minimum Stay
Rental rates are based on a two-night reservation. Longer stays may be required during holidays, peak seasons, or special events. If you require a shorter stay, please ask for availability and rate.
Cancellations, Refunds and Changes by Guest
Refunds for early departure will not be allowed.
All reservations cancelled 30 days or more before check-in date will receive a full refund of their stay. Security/damage deposit is non-refundable.
All reservations cancelled 30 days or less before check-in date will forfeit their security/damage deposit or advanced payments, whichever is greater.
All reservations not paid in full 30 days prior to check in date will be cancelled and guest will forfeit their security/damage deposit and any prior payments made.
Rates will not be reduced or refunded due to changes in occupancy by guest including but not limited to number of occupants, or pets.
Cancellations and Changes by Owner/Manager
The owner/manager of the vacation rental reserves the right to terminate this rental agreement at any time prior to the commencement of the rental term (whereupon all obligations and liabilities of the owner/manager hereunder shall terminate) for causes related to property maintenance, weather, power failure, air condition or heating failure, over booking, or any other reasons deemed necessary by owner/manager. If cancelled by owner/manager, all guest deposits and/or rental fees will be refunded.
Confirmation
We will contact you by email with a confirmation of your reservation upon receipt of the reservation deposit. Please review the confirmation and rental agreement carefully to verify the property rented, dates of the rental, charges, and any special notes. Contact us immediately to report any errors. After 3 days, the confirmation will be considered accurate.
Check-In
Check-in time is 3:00 pm. Please notify us if you plan to arrive after 8pm.
All guests must check-in by calling the office the day of their arrival. You will be given a code for the keypad and any special instructions needed. During peak season, unavoidable delays may occur. Your patience is appreciated.
Check-out is by 11:00 am.
Occupancy
The total number of persons allowed on the property, including children, at any time is restricted to the stated sleeping capacity for each property.
If it is found that the number of overnight guest, visiting or unauthorized guest or pets exceed the max amount of people specified, or if any parties are held on the premises, your security deposit will be forfeited and other fees could apply.
Smoking on the premises will result in the forfeit of the security deposit.
We are very serious about maintaining a family atmosphere for the quiet enjoyment of our guests. We rent to family groups, couples, and responsible adults. Gulf View Properties, LLC will not rent to anyone under 21 years of age. The person checking in must be the qualified person who is renting the property. The qualifying person renting the property is responsible for the conduct of all guests and other occupants, and must occupy the property for the full term of the reservation. Guests under 21 must have direct adult supervision at all times when on rental premises.
Absolutely no parties or illegal activities are allowed. Gulf View Properties, LLC reserves the right to enter the rental property at any time to investigate disturbances, occupancy, and/or damage. Any violators will be evicted without refund.
Unauthorized activity on the premises will result in the forfeit of Security Deposit.

Linens, Towels and Supplies
Linens and bath towels are provided for your convenience and are not to be taken from the unit. We suggest you bring beach towels. A small supply of trash bags, dish detergent, dishwasher detergent, laundry soap, paper towels, bath soap, and bathroom paper is provided to you by Gulf View Properties, LLC.
Departure Cleaning Fee
If any additional cleaning is required after you check-out or if furniture needs repositioning, you will be charged an additional fee and this fee will be deducted from your security/damage deposit.
Guest is responsible for :
Removing all food from the refrigerator.
Placing soiled dishes, glassware, silverware, and pots in dishwasher and cleaned.
Placing all debris, garbage, and discards outside in proper containers.
Leaving unit in a neat condition and furniture arranged as you found it.
Making sure that no items are missing from the unit. (There will be a charge for the cost of any missing items.)
Placing all remotes by the TV. (There will be a $50 charge for missing remotes.)
Please set the thermostat to 83 degrees in the summer and 55 degrees in the winter.
Close and lock all doors and windows.
There will be a minimum charge of $60 if additional cleaning or returning furniture back to its original position is required.
After Hour Emergencies
For emergencies after hours, you may call Kevin at 985-788-9561.
Please report any damages to the office as soon as possible. Failure to do so may incur some liability to the guest. No compensation will be given for temporary outage of electricity, gas, water, cable, or internet services. Outages should be reported immediately and all efforts will be made to have them restored as soon as possible. The operation and maintenance of these utilities are out of the control of Gulf View Properties, LLC. Air conditioners and heaters are not guaranteed and refunds cannot be given for failure or breakdown. Gulf View Properties, LLC will attempt to repair or replace any item during your stay. If a part has to be ordered and the item cannot be repaired before your departure, no money will be refunded.
Left Items
Gulf View Properties, LLC is not responsible for items left in the unit. A fee of $50 is charged plus shipping cost to cover the means of shipping any items requested by the guest.
Grilling
The use of grills on all wooden decks and wooden porches is strictly forbidden. A fee of $200.00 will be charged and deducted from your damage/security deposit.
Beach
Lessee agrees to release and hold harmless Gulf View Properties, LLC and its owner from any and all liability relating to water features or sports, i.e. swimming pools, bayous, rivers or Gulf access, use at your own risk. Further, they agree to indemnify Gulf View Properties, LLC and the owner from any liability causes of action and to be responsible for defending Gulf View Properties, LLC and said owner.
Pets
Pets will not be allowed on premises unless otherwise stated in the agreement. If pet is approved, a pet fee will be charged per day per pet in addition to your stay for a deep cleaning fee. If unauthorized pets are found on the premises, the security deposit will be forfeited.
PETS ARE NOT ALLOWED IN THE POOL AT ANY TIME. If evidence of pets being in the pool are found, the security deposit will be forfeited.
Non-Smoking
Smoking is strictly prohibited inside the house. If any evidence of smoking is found on the premises, guest will forfeit their security deposit along with any other charges that are incurred from this act. Any charges that exceed the amount of the security deposit will be charged to your credit card.
Parking
Please park in the designated parking areas only. The Bay St.Louis, MS. properties accommodate two/three vehicles. We can accommodate additional vehicles, boats, jet skis, or RV's, please let us know in advance so we can make arrangements before arrival.
Garbage
Garbage pick-up is on Monday & Thursday mornings and must be in bags or cans.
Fences
Gulf View Properties, LLC and its owner do not guarantee fences are suitable for containment of pets or children. Gulf View Properties, LLC and its owner are in no way responsible and shall be held harmless by guest in any situation regarding containment of pets or children including but not limited to accidents, injury, or loss.
Fireworks
The use of fireworks is prohibited on all properties. Local city ordinances and fire code prohibit the use of fireworks on beaches, buildings or grounds.
Inclement Weather
Refunds will not be given for inclement weather. In the event of mandatory evacuation by civil authorities, the unused portion of the rental period would be refunded.
Utilities
For your convenience, Wireless Internet is provided in the home. There are NO LANDLINE PHONES at the house. Guest must have a mobile/cell phone for communication. Guest must agree to and understand there is no landline/phone and agree that they have a mobile/cell phone for emergencies. Temporary outage of internet, electricity, water, or cable TV service may occur and are beyond our control.
Outages must be reported immediately and all efforts will be made to have them restored as soon as possible. The operation and maintenance of these utilities are out of the control of Gulf View Properties, LLC.
Agency Disclosure
Gulf View Properties, LLC is the agent of the property owner and is acting at all times, in and for the best interest of the owner. Gulf View Properties, LLC will treat all guests with honesty and fair dealing. Guest understands that security is not provided at any properties. Gulf View Properties, LLC and its owners are in no way liable for injury, damage, or violence that might happen to the guest while at this property. Gulf View Properties, LLC and its owners will not be held responsible for acts of theft, vandalism, or damages to the guest's personal property.
If is further mutually agreed between the parties as follows: •
Guest shall not violate any city ordinance or state law in or about the premises.
• Guest shall not sublet the demised premises, or any part thereof, or assign this agreement without written consent of the owner.
• Guest, in case of fire or theft, shall give immediate notice thereof to the owner or agent of same.
• Guest must not make any alterations to said premises.
• If legal action takes place or must be instituted by owner, guest agrees to pay all costs and expenses and to pay all attorney's fees, as the court may affix.
• Cooking utensils and kitchen equipment are furnished for your convenience. All dishes and cooking utensils should be left in clean condition upon departure.
• Linens and bedding are also furnished for your convenience. All beds used are to be stripped of linens at departure and left with any used towels at washer/dryer.
• Under no circumstances shall barbeque grilling be allowed on wood porch or deck.
• No smoking or candles allowed inside the house. This will result in the forfeit of your security deposit.
• Appliances, air conditioners/heaters, and hot water heaters are not guaranteed and refund cannot be given for failure or breakdown. Gulf View Properties, LLC will make every attempt to repair or replace any item that is inoperable as quickly as possible.
A security deposit in advance is required to reserve dates. If guest fails to rent property for agreed term, this deposit will be non-refundable. If guest rents the said property for the agreed term, this deposit will be used as the damage deposit. This deposit will be refunded within 30 days if premises are left in good condition. If expenses are incurred by owner to restore the premises to the condition they were in at the time of guest occupancy, the amount necessary for said restoration will be deducted from the damage deposit and the balance, if any, will be refunded to the guest. If charges exceed the amount of damage deposit, the guest must pay the balance due.
PRIVACY POLICY:
We respect and are committed to protecting your privacy.
We may collect personally identifiable information when you visit our site. We also automatically receive and record information on our server logs from your browser including your IP address, cookie information and the page(s) you visited. We will not sell your personally identifiable information to anyone.
SECURITY POLICY
Your payment and personal information is always safe. Our Secure Sockets Layer (SSL) software is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal information, including credit card number, name, and address, so that it cannot be read over the internet.”
